As Tax Collector, I am responsible for the collection of property taxes for approximately 1982 parcels.  The duties of this office, as well as the collection procedures are statutory and defined by the New York State Real Property Tax Law.

Any inquiries are welcome with regards to collection policies and general tax information.  Assistance is provided to residents, realtors, lending institutions, title companies and other entities that may require information.

Before entering upon the duties of this office, it is required that all tax collecting officers take the Constitutional Oath of Office.  In addition, an official undertaking of bond, which guarantees the faithful performance of the office must be executed and filed in the Town Clerk’s Office.  Once the collector has taken the oath and executed the bond, she or he becomes an insurer and guarantor of all monies, securities, papers and records that the law provides shall be in his or her custody.

Property tax bills are mailed in early January.  Payments can be made upon receipt of bill thru February 28th without penalty.  If they are paid after February 28th, the penalty schedule is as follows:

January to February 28, 0% (percent) penalty;

March 1 to March 31 – 2% (percent) penalty;

April 1 to April 30 – 3% (percent) penalty;

May 1 to May 31 – 4% (percent) penalty;

June 1 until settlement with County Treasurer, 5% (percent).

In addition, after May 15, a fee of $2.00 will be added for each parcel.

IMPORTANT INFORMATION FOR PROPERTY OWNERS

New York State Law states whether you receive a bill or not, you are ultimately responsible for payment including penalties.  Once a bill is in the penalty stage, payment cannot be accepted without the penalty.

Frequently Asked Questions

I never received my bill or I received it late, do I still have to pay the penalty?

Yes. Failure to mail a statement or the failure of the property owner to receive a statement will not affect the validity of the taxes or penalty as dictated by law (New York State Real Property Tax Law §922). The Tax Collector does not have the legal authority to waive statutory penalty charges, nor does any other official. These regulations are governed by the Real Property Tax Law. If the collector waives any penalty he/she will be held personally responsible. All records are audited by State examiners and there is no discretion in this matter.

If I mail my payment on the due date, do I have to pay a penalty?

New York State Real Property Tax Law §925, provides as follows: “Payment of taxes by mail, when enclosed in a postpaid wrapper (envelope) properly addressed to the appropriate collecting office and is deposited in a post office of official depository under the exclusive care custody of the United States Post Office shall, upon delivery, be deemed to have been made to such officer on the date of the United States Postmark on such wrapper. ” The provisions of this section shall not apply in the case of postmarks not made by the United States Post Office. A postage meter postmark is not a postmark made by the United States Post Office and will not be honored according the provisions of Real Property Tax Law §925.

Payments received after the due date will be returned for proper payment to include the appropriate penalty. No town official or employee can waive the penalty.

Do you accept payment with credit cards?

Yes. Payment may be paid in person during regular business hours or by visiting the town’s website, www.ameniany.gov and selecting pay your taxes or at http://egov.basgov.com/amenia/

The Town of Amenia Tax Collector will be accepting online & Credit Card payments for Dutchess County Town and County Real Property Tax Bills. There is a convenience fee that will be applied for the service. The fees are as follows: Visa, Master card and Discover Credit Card 2.45% percent of total tax payment Visa Debit $3.95 E-Check $1.75

Can I pay my property taxes in installments?

No. The Town of Amenia does not accept partial payments. Payment must be made in full or it will be returned for proper payment.

When can I make in person payments to the Tax Collector?

Payments will be collected at Amenia Town Hall, Town Clerk’s Office, 4988 Route 22, Amenia NY 12501 – Monday through Thursday 9am-2pm

2024 Tax Warrant

NOTICE OF RECEIPT OF TAX ROLL AND WARRANT

TAKE NOTICE, that I, Dawn Marie Klingner, the undersigned Collector of Taxes of the Town of Amenia, County of Dutchess and State of New York, have duly received the tax roll and warrant for the collection of taxes within the Town of Amenia for the year 2024, and that I will attend at 4988 Route 22, Amenia from January 2, 2024 to February 29, 2024, 9:00 o’clock in the forenoon to 2:00 o’clock in the afternoon on each day, excepting Fridays, Saturdays, Sundays and holidays for the purpose of receiving the taxes listed on the said roll.
TAKE FURTHER NOTICE, that taxes may be paid on or before February 29, 2024. On all taxes received after such date, there shall be an additional one percent for each additional month or fraction thereof thereafter until such taxes are paid or until the return of unpaid taxes to the county treasurer pursuant to law.
